Terms & Conditions
1. General
By placing an order with Pasticceria Italia, you agree to these Terms & Conditions. These terms apply to all custom cakes, cakes, desserts, catering services, cannoli classes, gelato products, and event orders.
2. Quotes & Pricing
All quotes are valid for 14 days unless otherwise stated. Prices are subject to change without notice until an order is confirmed and a deposit is paid. Final pricing may vary if changes are requested after the original quote has been provided. All prices are in Australian Dollars (AUD).
3. Order Confirmation
Orders of products available for purchase online are confirmed at the time of purchase. For all custom cakes, catering services, classes and event orders, such orders are not confirmed until the required deposit has been received. Pasticceria Italia reserves the right to decline any order at its discretion.
4. Deposits & Payments
For all custom cakes, event catering, classes and event orders, a non-refundable deposit of 50% is required to secure an order. The remaining balance must be paid no later than 21 days before collection or delivery unless otherwise agreed.
Orders not paid in full by the due date may be cancelled without refund of any deposit paid.
5. Cancellations & Refunds
(Customer Cancellations)
If a customer cancels an order more than 21 days before the agreed collection or delivery date, then any payments made beyond the 50% non-refundable deposit will be refunded. If a customer cancels an order 21 days or less before the agreed collection or delivery date, no refunds will be provided, as materials, production time, and booking capacity have been allocated specifically to your order.
(Business Cancellation)
If Pasticceria Italia is unable to fulfil an order due to unforeseen circumstances, a full refund of all monies paid will be provided.
6. Design & Custom Orders
Inspiration photos are accepted as reference only. Pasticceria Italia does not guarantee a replica of any cake, dessert, or design created by another business. Artistic interpretation may be necessary. Colours may vary due to edible colouring products, lighting, photography, and printing methods. We reserve the right to substitute ingredients where reasonably necessary, provided that the substituion does not materially reduce the quality of the product and does not conflict with notified dietarty requirements. Any cake designs shown to customers are owned by Pasticceria Italia, and are not to be used to provide a reference to other businesses. Any changes requested after an order has been confirmed may incur additional charges. Significant design, flavour, size, or quantity changes are subject to availability and may not be possible within the remaining production timeframe.
7. Edible Images & Decorations
Edible images may vary slightly in colour from the original supplied artwork.
Customers are responsible for ensuring they have permission to use any copyrighted images provided for printing. Pasticceria Italia is not responsible for copyright infringements arising from customer-supplied images.
8. Allergens
Our products may contain or come into contact with: Milk, Eggs, Wheat, Gluten, Soy, Peanuts, Tree Nuts, and Sesame. While reasonable precautions are taken, products are prepared in a kitchen that handles allergens. We cannot guarantee any product is completely free from traces of allergens. Customers with severe allergies should carefully consider this before placing an order.
9. Collection
Customers are responsible for inspecting their order at collection. Once the order has been collected, the customer accepts the condition of the order and responsibility for any damage to the order from collection. Safe transport instructions should be followed by the customer. Pasticceria Italia is not responsible for any damage occurring after collection, including damage caused during transportation, handling, storage, or display.
10. Delivery
Delivery times are estimates and may vary due to traffic, weather, or unforeseen circumstances. A suitable person must be available to accept delivery. Pasticceria Italia is not responsible for any damage occurring after delivery. Storage instructions should be followed by the customer.
11. Storage & Handling
Products should be stored according to the instructions provided.
After collection or delivery, Pasticceria Italia is not responsible for damage resulting from any cause, including but not limited to the following causes:

12. Fresh Products
Many of our products are made fresh and are best consumed within the recommended timeframe. Due to the perishable nature of our products, refunds will not be provided simply because a product was not consumed within the recommended period.
13. Photography
Pasticceria Italia reserves the right to photograph completed products and use those photographs for marketing, social media, advertising, website content, and promotional purposes unless otherwise agreed in writing.
14. Event Catering & Cannoli Classes
For catering events, workshops, and cannoli classes:
Final guest numbers must be confirmed no later than 21 days before the agreed event date. Any dietary requirements must be disclosed 21 days in advance. Additional guests may incur extra charges.

To the maximum extent permitted by law, Pasticceria Italia is not liable for indirect, incidental, or consequential loss arising from or in connection with your use of this website, online ordering platform or the purchase, collection, delivery, or consumption of our products. Nothing in these Terms & Conditions excludes any consumer guarantees or rights available under Australian Consumer Law that cannot be excluded or restricted by law.
